Arid Music Business Terms

INTRODUCTION

Arid Music is a Not-for-Profit Enterprise. Its purpose is to promote live music, encourage local amateur musicians and assist
venue organisers in finding suitable performers through advertising and personal contacts.

SPECIAL TERMS

The following terms within quotation marks have a specific meaning throughout this document as follows:

• "The Arid Music Web-site" - The web-site www.aridmusic.com and all associated web pages.
  
• "Business Information" - Any detail, data or fact supplied to The Arid Music Web-site Owner.
  
• "Samples" - Items of music and publicity material supplied by any person to The Arid Music Web-site Owner.
  
• "The Supplier" - The Arid Music Web-site Owner - David I Wilcox.
  
• "The Customer" - Any person who supplies Business Information or Samples to the Arid Music Web-site owner for any  
  purpose.
  
• "Arid Music Business Terms" - This document and its provisions.
  

RESPONSIBILITIES

The Customer's Responsibilities.

In supplying Business Information to us or entering agreements with the Arid Music Web-site Owner, you, the
Customer, accept the Arid Music Business Terms. A printed copy of the Arid Music Business Terms can be supplied
on request for an administrative charge.

You, the Customer, supply Business Information to or enter agreements with the Arid Music Web-site Owner at your
own risk. In supplying any Business Information to the Arid Music Web-site Owner you:

• Agree to supply your full name and address to the Arid Music Web-site Owner
  
• Agree to the Arid Music Web-site Owner sending you promotional email from time to time.
  
• Agree to the display of your band name, associated web-site and other Business Information agreed with you
  on the Arid Music Web-site.
  
• Agree to check the Arid Music Web-site at least weekly for accuracy of the Business Information displayed about
  you and to ensure that Business Information is up-to-date.
  
• Confirm that you have read, understood and agree to Arid Music Business Conditions.
  
• Confirm that all other parties to whom Business Information the supplied by you refers have read, understood
  and agree to Arid Music Business Conditions.
  

In supplying Business Information for use on the Arid Music Bands Directory page you, the Customer, agree to the Arid
Music Web-site Owner establishing a proxy email address, such as bandname@aridmusic.com, to allow inbound
communication without disclosing your email address.

Email sent to the proxy email address is redirected to the mailbox admin@aridmusic.com and will be forwarded to your
own nominated email address. Email sent the proxy email address may be read by the Arid Music Web-site Owner
during the transfer process but will not be passed to third parties. If you wish to display your own email address
instead of the Arid Music proxy email address on the Arid Music Web-site, you must notify the Arid Music Web-site
Owner.

The Supplier's Responsibilities.

Arid Music Web-site Owner undertakes to display the Business Information agreed with you on the Arid Music Web-site
for the period of time agreed with you subject to the following limitations:

• Telephone numbers will not be published on the Arid Music Web-site in any circumstances.
  
• Surnames will only be published on the Arid Music Web-site with specific agreement of the named individual
  when part of a stage name.
  
• The Arid Music Web-site Owner reserves the right to refuse publication of offensive material. In this case, any
  consideration will be returned.
  
• The Arid Music Web-site Owner reserves the right to refuse to publish copyright protected material, including
  songs, without appropriate permission.
  

The Arid Music Web-site Owner undertakes to make all necessary amendments to Business Information displayed on
The Arid Music Web-site promptly on request. All other data that you, the Customer, provide will not be passed on to
third parties without your express permission.

The Arid Music Web-site Owner reserves the right to remove any Business Information displayed on the Arid Music
Web-site where the originator of that Business Information cannot be contacted by email for a period of longer than one
month.

LIABILITY

The Arid Music Web-site Owner takes no responsibility for organising any events or performances and makes no guarantees
in respect of the individual performers or the nature or quality of the music they perform.

The Arid Music Web-site Owner does not accept liability for:

• Failure to provide any service due to circumstances or events beyond his control, including failure of a third party
  service provider to provide a service critical to the operation of the Arid Music Web-site.
  
• Any error, omission, damage or consequence resulting from display, inaccuracy or absence of information on the Arid
  Music Web-site or associated links.
  
• Any error, omission, damage or consequence resulting from a failure the Arid Music Web-site Owner to communicate
  information.
  
• Failure of any person whose details appear on the Arid Music Web-site to fulfil a contract made with a third party.
  
• Bookings or gig arrangements between any persons.
  

BUSINESS INFORMATION SECURITY

The Arid Music Web-site Owner undertakes to retain only the minimum Business Information required to undertake his
business and will secure this data in an appropriate manner.

Business Information supplied to the Arid Music Web-site Owner is stored on a computer database. The Arid Music Web-site
Owner undertakes to supply details of data held, whether displayed or otherwise, on request. Data will be removed from Arid
Music records on request. A small fee may be charged for this service.

SAMPLES

Samples received by the Arid Music Web-site Owner are not returnable and will not be passed to third parties without the
Customer's express permission. The Arid Music Web-site Owner undertakes to treat Samples as Business Information for
security purposes.

LAW

All contracts and agreements between the Arid Music Web-site Owner and others will be governed by English Law.
